I"m seeking clarifica*****ion of *****he posi*****ion of *****he planning dep***** on *****he s*****a*****us of Uni***** 385, Men*****more *****errace. My FOI reques***** is as follows: Clarifica*****ion as *****o why, in *****he Planning Au*****hori*****y Represen*****a*****ion of 12 Augus*****, *****he ca*****egorisa*****ion for Uni***** 385 is no***** given as A3 ie (according *****o *****own and Coun*****ry Planning Use Order of 1987): "Food and drink: Use for *****he sale of food or drink for consump*****ion on *****he premises or of ho***** food for consump*****ion off *****he premises." Please supply links *****o relevan***** legisla*****ion or preceden***** *****ha***** informed *****he decision *****o gran***** con*****inued B1c s*****a*****us. (as a no*****e, *****he uni***** is producing and selling ho***** food, and is selling drinks for consump*****ion off *****he premises, *****his was *****he basis of *****he applica*****ion *****o *****he Licensing Commi**********ee). Clarifica*****ion on how *****he ca*****egorisa*****ion of Uni***** 385 as B1c (or any ca*****egory under B1) is affec*****ed by *****he Licensing Commi**********ee"s acknowledgemen***** *****here has been a significan***** de*****rimen***** *****o *****he ameni*****y of *****he area, by reason of noise, vibra*****ion, fumes and public nuisance. Please supply any evidence held by *****he Planning Dep***** *****ha***** *****he curren***** occupan*****s are no***** causing significan***** de*****rimen***** *****o *****he ameni*****y of *****he area. A represen*****a*****ion was made by *****he Planning Au*****hori*****y *****o *****he Licensing Commi**********ee, in which a ca*****egory was given. Presumably *****he view of *****he LPA in *****his ins*****ance is no***** arbi*****rary, bu***** is ei*****her based on preceden*****, or *****he con*****ex***** of developmen***** wi*****hin *****he area. Under *****he FOI *****he Planning Depar*****men***** is obliged *****o explain why *****he ca*****egorisa*****ion is no***** given as A3.
I***** does no***** adequa*****ely answer *****he following:
Please supply links *****o relevan***** legisla*****ion or preceden***** *****ha***** informed *****he decision.

We can confirm *****ha*****, as per *****he con*****en*****s of *****he reps, reps on a licensing applica*****ion are no***** a decision on *****he par***** of *****he LPA. Informa*****ion abou***** use class can be found on *****he planning por*****al ( h**********ps://www.planningpor*****al.co.uk/info/200130/common_projec*****s/9/change_of_use ). We can also advise *****ha***** *****here have been a number of revisions from *****he original legisla*****ion made in 1987.
