Thank you for your request for information under the Freedom of Information Act 2000, received 24 May 2020. Your request has been considered and our response is in bold below.
You requested the following:
Victoria Park has been closed and then subject to restrictive opening hours, LBH"s reasoning for this is COVID-19. In deciding to close the Park and restrict hours to the Park, LBH is required to take account of potential disproportionate impacts on parties with a relevant protected characteristic and there should be a written record of this for the Council"s decision to comply with the 2010 Equality Act and be immune from an Equalities Act legal challenge. In particular in your Borough and in close proximity to the Park are a very large number of young people and young families who live in overcrowded accommodation, share houses and the like. These young people are at a very low risk from COVID but their housing situation and impact on their jobs from the recession puts them at significant risk of mental health issues. Restricting access to open spaces increases this risk and represents a obvious disproportionate impact from closing the Park. Please provide any written records that evidence compliance with the Council"s Public Sector Equality Duty in the decision making to close and restrict opening hours to Victoria Park.
