Thank you for your request for information under the Freedom of Information Act 2000, received 29 June 2020. Your request has been considered and our response is in bold below.
You requested the following:
We, at Caterers Association UK, are doing a survey to find out the total number of Indian and Bangladeshi restaurants across the UK. To help with the survey we would like to request the names, addresses, email addresses and telephone numbers of every Indian and Bangladeshi restaurants which are registered with your council as of 25/06/2020.
The Council’s Response
The information you requested is exempt under Section 12 of the Freedom of Information Act 2000 (Cost & Time exceed the appropriate limit).
Unfortunately, the Council does not have any simple method of accessing this information. In order to answer your question, we would need to manually examine 2,379 individual records on our database and associated inspection paperwork, as our database does not record the type of cuisine prepared in commercial businesses.
Section 12 of the Act states that the Council is not obliged to comply with a request for information if the authority estimates that the costs of complying with the request would exceed the appropriate limit.
The appropriate limit is represented by the estimated cost of one person spending 2½ working days (or 18 hours) in determining whether the Council holds the information, and locating, retrieving and extracting the information requested. Consequently, the Council is not obliged to respond to your request under the Freedom of Information Act 2000.
Manually sorting through 2,379 premises and associated paperwork would exceed 18 hours.
The Information Commissioner advises that if even one part of a request would be exempt under Section 12, we should exempt the whole request.

If you are dissatisfied with this response and wish to appeal, please reply to this email and this will be dealt with through our Internal Review procedure.
Your request should be submitted to us within 40 working days of receipt by you of this response. Any request received after this time will only be considered at the discretion of the Council.
