Cost saving & carbon saving energy (FOI-2006)
Dear Hackney Council,
I would like to make a Freedom of Information Act request. Please could you provide me with the email address of both your Energy Manager and the Estates Manager details in order to supply Hackney Council with cost saving & carbon saving energy storage products.
Re: Freedom of Information Request.
Thank you for your request for information under the Freedom of Information Act 2000, received 23 November 2018.
Your request has been considered and our response is in bold below.
You requested the following:
Please could you provide me with the email address of both your Energy Manager and the Estates Manager details in order to supply Hackney Council with cost saving & carbon saving energy storage products.
The Council’s Response
We have considered your request and is advising you that the contact details of officers you requested is exempt under Section 40 and 21 of the Freedom of Information Act 2000. Please below the exemption applicable and the reason(s) why it has been applied.
"S40(2) Personal Information
The Council has considered exemption S40(2) in the processing of your request. A public authority is only obliged to publish the first 3 tiers of its structure. The Council has to consider whether it would be ‘Fair and Lawful’ as per the 1st Data Protection Principle to publish the names of staff who are not senior management.
Additionally, the Council also considers the impact disclosure of direct contact details, as well as names of staff who are not senior management, would have on those members of staff. As a Freedom of Information request is considered to be disclosure to the public at large, the Council is not satisfied that disclosure of direct contact details or names of staff other than senior staff would be fair and as such considers S40(2) to be engaged.
S21 Information readily accessible elsewhere
The Council has considered S21 of the FoI Act 2000. A public authority is only obligated to publish the top three tiers of senior management within the Council.
In this case the organisational structure is available at http://www.hackney.gov.uk/council-structure. As such the Council considers S21 to be engaged.
