Thank you for your request for information under the Freedom of Information Act 2000, received received 2 January 2019. Your request has been considered and our response is in bold below.
You requested the following:
Can the Hackney FOI dept please clarify whether a statutory request for the purposes of an FOI shows on paper guidance documents under the authority of the legislation/ the legislation itself that a request is only statutory when requested to the specific FOI department.
The Council’s Response
We can confirm that a statutory FOI Request is legally considered as such wherever in the Council it is received. Our usual advice for departments is that they should be passed to the Information Management team to be logged and allocated, and the due date is 20 working days from the first receipt of the request within the Council.
- We encourage people to make FOI requests to the Council via our online request form: https://hackney.gov.uk/foi-request
- Where FOI requests are made directly to other officers, our procedure is that those are referred to the Information Management team so that they are logged and processed accordingly.
Appeals & Complaints Procedure
If you are dissatisfied with this response and wish to appeal, please write to the Information Management Team and this will be dealt with through our Internal Review procedure.
